Drop Shipping Legal Questions — Are You Allowed To Clone Suppliers’ Products? | TBS #223

Podcast

If you drop ship products from AliExpress you obviously have to clone the products on your own store. This means you’re using the pictures and other information from the supplier on your own website.

So the questions is: Are they okay with this?

Many suppliers on AliExpress will write in their description that they support drop shipping. For them it’s a great setup, since you bring them additional sales that they wouldn’t be getting otherwise. You run the ads, you invest the money, you take the risk and all they get is more sales without any commitment or investment on their side.

That’s why a huge part of suppliers on AliExpress actually want you to drop ship their products and mention that they support it. However, not all suppliers will mention this in the description of the product.

So when in doubt, always reach out to the supplier and ask.

Just shoot them a message and share your plans, explain what you’d like to do and ask them if it’s okay with them if you drop ship their products. Communicating with suppliers on AliExpress isn’t always easy, but they should get back to you with an answer about it.

You can also ask the supplier if it’s okay to use the product images and other information from their store to promote the product.

If you’re in doubt about copyright, trademarks and brands always contact the supplier before you start drop shipping. Now, even if the supplier mentions it’s okay to drop ship a certain product, you should still be careful and make sure you aren’t breaching any trademarks.

Just because some “shady” Chinese supplier says that you can drop ship Pokemon Go merchandise, doesn’t actually mean they have the permission to create these products, sell them or even have the legal authority to give you permission to sell these products. So always be cautious and if in doubt, contact a lawyer or legal professional.

Personally, I just like to stay away from any sort of products that are linked to brands, TV shows, movies, games, celebrities and so forth. There’s plenty of other great items on AliExpress you can sell.

It makes me nervous because I never know what is trademarked or patented. So I saw a product that said patent pending. I would assume it would not be wise to sell a look a like product from AliExpress even if the brand name is not found on it. Also, I would assume “as seen on tv” should be avoided too. Especially since most of them have the trademark after their name. But, what if their brand and name is trademarked, but the product is not patented? Is a look a like product okay? So many questions. I got nervous on what to sell sometimes, which can end up being limiting on finding winning products.
