Do I Need A Trademark? How To Get A Trademark To Protect Your Brand | TBS #133

Podcast

It’s not a question to get a trademark to protect your brand, it’s simply a question of financial pay off and ROI for your business.

The only reason to get a trademark is when:

1) There’s a financial payoff and you make more money

2) You’ve reached “dangerous” levels of success

What I mean with that first reason is that trademarks are a strategic move for brands to make sure nobody else can take a piece of the cake that they’ve baked in the first place. If you own a large share of the market, having a trademark allows you to make more cash.

Why?

Because you can get rid of anyone who’s trying to piggyback or copycat your brand and your products. And that means you will own more of the market, which results in you making more money.

And the second reason to get a trademark is when you’re starting to become so successful that you have the attention of the public.

I’m not talking about what you think success is.

We’re talking about complete, explosive success to the point where everyone starts talking about your brand and what you do.

When you start seeing that type of success, get a trademark. You’ll need it.

But if you’re just starting out and registering a brand new company, don’t get a trademark. There is no financial payoff for you, and nobody gives a damn about you. You gotta do a reality check and realize that nobody even wants to copy your “inexistent” brand.

So registering a trademark is just a liability at that point, and it’s not a viable investment that has a positive ROI for your company.

I made this same mistake and got a trademark early on.

If I had to start over again, I wouldn’t do it anymore.
